1. Overview

These Terms of Service govern your access to and use of www.hathasoda.com, including purchases made through the website. Throughout these Terms, “HATHASODA,” “we,” “us,” and “our” refer to the HATHASODA store and brand.

By visiting the website or purchasing a product, you agree to these Terms and to the policies incorporated by reference, including our Refund and Return Policy, Shipping Policy, and Privacy Policy. If you do not agree, do not use the website or place an order.

2. Eligibility and Lawful Use

You must be legally capable of entering into a binding agreement in your place of residence. If you are not the age of majority, you may use the website only with the involvement and permission of a parent or legal guardian.

You may not use the website or our products for any unlawful purpose or violate any applicable law in connection with your use of the website.

3. Products

HATHASODA sells manually operated, non-electric home sparkling water makers. A CO2 cylinder is not sold or included with the machine. Customers must obtain a compatible cylinder separately. The machines are designed for market-standard 60L threaded TR21-4/CGA320 cylinders.

The included carbonation bottle is a reusable PET water bottle; it is not a CO2 cylinder.

Product colors and appearance may vary slightly because of photography, lighting, manufacturing tolerances, and device display settings. We make reasonable efforts to describe products accurately, but minor visual differences do not necessarily mean a product is defective.

You are responsible for reviewing the product description, compatibility information, and instructions before use. Products must be used only as directed and with compatible components.

4. Prices and Currency

All prices and transactions on the website are stated in U.S. dollars unless expressly indicated otherwise. Prices may change without notice, but a price change will not alter the price of an order already accepted by us.

Applicable sales tax will be calculated where required. The total amount presented during checkout is the amount submitted for payment, subject to correction of an obvious error as described below.

5. Orders

Your submission of an order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory unavailability, pricing or product-information errors, address problems, or violation of these Terms.

An order confirmation acknowledges that we received your order; it does not necessarily mean the order has shipped. If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

You agree to provide current, complete, and accurate purchase, billing, and shipping information.

6. Payment

You represent that you are authorized to use the payment method submitted at checkout. You authorize the applicable payment provider to charge the order total, including taxes where applicable.

Payment processing may be provided by third parties. Their services may be governed by additional terms and privacy policies.

7. Shipping and Delivery

We currently ship only within the United States. Shipping timelines, tracking, address restrictions, delays, and damaged-delivery procedures are described in our Shipping Policy.

If we cannot ship within the promised period, we will provide the options required by applicable law, which may include accepting a revised shipment date or cancelling the unshipped order for a full refund.

8. Returns, Refunds, and Cancellations

Returns and refunds are governed by our Refund and Return Policy. You must follow the return-authorization process before sending a product back.

Nothing in these Terms limits rights or remedies that cannot legally be waived.

9. Limited Warranty

HATHASODA products may be covered by a limited warranty. Where a limited warranty applies, the written warranty terms accompanying or posted for that product govern its duration, scope, exclusions, claim process, and available remedies.

The limited warranty is separate from the return window and does not restrict mandatory rights under applicable law.

10. Website Information and Errors

We may correct typographical errors, inaccuracies, or omissions relating to product descriptions, availability, pricing, promotions, shipping, or other website content.

If an error materially affects an order, we may contact you for confirmation or cancel the affected portion and issue a refund. We will not knowingly use this provision to avoid an otherwise valid order.

11. Prohibited Uses

You may not:

• Use the website for unlawful, fraudulent, abusive, or deceptive activity;
• Interfere with website security, availability, or operation;
• Introduce malware or other harmful code;
• Attempt unauthorized access to accounts, systems, or data;
• Scrape, copy, or exploit website content in violation of applicable law;
• Impersonate another person or submit false information; or
• Use the website in a way that infringes another person’s rights.

We may suspend or terminate access for a material violation of these Terms.

12. Intellectual Property

The website and its content, including text, graphics, product images, branding, logos, design elements, and software, are owned by or licensed to HATHASODA and are protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping and informational purposes. No content may be reproduced, distributed, modified, sold, or commercially exploited without prior permission, except where permitted by law.

13. Third-Party Services and Links

The website may use or link to third-party services, including payment, analytics, shipping, or social-media services. We do not control independent third-party websites and are not responsible for their content or practices.

Your use of a third-party service may be governed by that provider’s terms and privacy policy.

14. Reviews and Other Submissions

If you submit a review, photo, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights.

You grant HATHASODA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute submitted content in connection with our business, subject to applicable privacy law. We may remove content that is unlawful, misleading, abusive, infringing, or unrelated.

We will not require or condition support, warranty service, or a refund on the submission of a positive review.

15. Privacy

Our collection and use of personal information are governed by our posted Privacy Policy. Shopify and other service providers may process information as necessary to operate the store and complete transactions.

16. Disclaimer of Warranties

Except for any express written product warranty and rights that cannot be excluded by law, the website and its content are provided on an “as available” basis.

To the fullest extent permitted by law, we disclaim implied warranties relating to the website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow certain warranty exclusions, so these exclusions may not apply to you.

17. Limitation of Liability

To the fullest extent permitted by law, HATHASODA will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law. These limitations do not apply to liability that cannot legally be limited, including any rights arising from applicable product-liability or consumer-protection law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold HATHASODA harmless from third-party claims arising from your unlawful use of the website, your material violation of these Terms, or your infringement of another person’s rights.

19. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

20. Termination

These Terms remain effective unless terminated by you or us. You may stop using the website at any time. We may restrict access where reasonably necessary because of unlawful activity, security risk, fraud, or a material violation of these Terms.

Provisions that by their nature should survive termination will remain effective, including provisions concerning payment obligations, intellectual property, disclaimers, liability, indemnification, and dispute-related rights.

21. Entire Agreement

These Terms and the policies incorporated by reference constitute the agreement between you and HATHASODA concerning your use of the website and purchases through it, except for any separate written warranty or agreement that expressly applies.

22. Governing Law

These Terms are governed by the laws applicable to HATHASODA’s operations and to the transaction, without limiting mandatory consumer protections available in the customer’s jurisdiction. A more specific state-law designation may be added after HATHASODA’s operating entity and principal place of business are finalized.

23. Changes to These Terms

We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. The Terms in effect when an order is placed will govern that order.
